These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Vontae Mack LLC, doing business as and operating tothemoon.baby (“Company,” “we,” “us,” or “our”).

By purchasing advertising “fuel,” submitting a listing form, or accessing and using tothemoon.baby (the “Site”), you expressly agree to be bound by these Terms, our site Rules, and our Privacy Policy. If you do not agree to these Terms, you must immediately cease all use of the Site and refrain from making any purchases.

1. Description of Service

To the Moon provides paid digital advertising and visibility services. User listings are displayed on a public board as dynamic “rockets” and text cards. Specific placement, ranking, and display parameters are determined by the amounts paid and are subject to the governing site Rules.

No Guarantees: We provide visibility space only. We do not guarantee traffic, clicks, sales, search engine optimization (SEO) rankings, or any specific commercial results or business outcomes.

2. Eligibility

By using this Site or making a purchase, you represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into a binding contract. If you are completing a purchase on behalf of a company, corporation, or other legal entity, you represent and warrant that you have the explicit authority to bind that entity to these Terms.

3. Accounts and Checkout Workflow

    • Guest Checkout: Users are permitted to complete transactions as guests without creating a permanent user account.

    • Communication Requirements: You must provide a valid, active, and monitored email address during checkout to receive order communications and updates.

    • Payment Processing: Transactions are securely processed via third-party processors, including WooCommerce and Stripe. By completing a purchase, you agree to comply with the respective terms of service and privacy policies of these third-party payment gateways.

4. Products, Packaging, and Pricing

    • Digital Services: “Rocket fuel” and all related digital goods offered on the Site are strictly digital listing and promotional services. All prices are listed and payable in United States Dollars (USD).

    • Price Modifications: We reserve the right to alter pricing, product variations, tiered structures, or product names at any time without prior notice.

    • Price Protection: The price paid for a completed, finalized order will remain fixed for that specific transaction. Price changes will not retroactively affect successfully processed orders.

5. Listing Content and Intellectual Property License

    • Grant of License: By submitting a listing, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to display your provided business name, URL, industry category, tagline, promotional blurb, and associated images on the Site and across our official social media channels.

    • Content Ownership and Representation: You retain ownership of your original listing text and assets. However, you warrant that you possess all necessary rights, trademarks, and permissions to utilize and distribute the submitted content, that the content is accurate, and that it complies fully with our site Rules.

    • Editorial Discretion: We reserve the right to reject, delay publishing, modify for length/formatting, or permanently remove any listing at our sole discretion.

6. Publication Schedule and Operational Cutoffs

    • The Board Schedule: The public board is updated according to a set schedule. Currently, the order cutoff time is 9:00 a.m. Eastern Time, and the updated board publishes at 12:00 p.m. (Noon) Eastern Time. This structured timeline is an inherent part of the digital product.

    • Post-Cutoff Processing: Any purchase completed after the 9:00 a.m. Eastern cutoff is not considered a failed transaction. It will automatically queue for publication on the following scheduled board update.

    • Force Majeure: While we make every effort to adhere to the noon publication schedule, updates may occasionally be delayed due to illness, server outages, technical errors, or other unforeseen events beyond our reasonable control (Acts of God). In such cases, we will publish the board as soon as operations are restored.

7. Ranking Mechanics and Corrections

    • Gamification and Placement: Board rank and the designated “moon seat” are governed strictly by the formulas outlined in our site Rules.

    • Error Correction: In the event of a manual ranking error or administrative glitch, corrections will be applied to the next scheduled board update following discovery, to the best of our administrative ability.

8. Payment Authorization

By clicking the “Purchase,” “Place Order,” or equivalent transactional button, you explicitly authorize Vontae Mack LLC to charge your provided payment method for the total disclosed order amount.

9. Cancellation and Refund Policy

    • All Sales Final: Due to the immediate allocation of resources and the digital nature of advertising placement, all purchases of “rocket fuel” and related services are strictly non-refundable.

    • Rules Violations: If a submitted listing is rejected, paused, or terminated due to a violation of our site Rules (including, but not limited to, linking to illegal sites, fraudulent scams, or prohibited content), no refund will be issued.

10. No Endorsement or Partnership

The publication of a listing on the Site does not constitute an endorsement, approval, or recommendation by us of that specific business, product, or service. Listed entities are independent third parties; no partnership, joint venture, agency, or employment relationship is created between you and Vontae Mack LLC.

11. Acceptable Use Policy

You agree that you will not engage in any activity that harms or disrupts the Site. Specifically, you agree not to:

    • Attempt to breach the security or disrupt the integrity of our web servers.

    • Scrape, crawl, or harvest data from the Site in an aggressive manner that degrades performance or causes downtime.

    • Impersonate any other individual, brand, business, or entity.

    • Utilize our payment checkout infrastructure for any fraudulent activities or money laundering.

12. Proprietary Rights

All original elements of the Site—including its design, layout, custom rocket board architecture, branding, logos, graphics, and original written content—are the exclusive intellectual property of Vontae Mack LLC and are protected by applicable copyright and trademark laws.

13. Disclaimers of Warranties

THE SITE AND ALL RELATED SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. VONTAE MACK LLC EXPLICITLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not warrant that the board will operate continuously without interruption, that it will be entirely free of errors, or that the graphical components will render perfectly across every mobile device, browser version, or operating system.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF VONTAE MACK LLC FOR ANY CLAIMS, DAMAGES, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR YOUR PURCHASES SHALL BE STRICTLY CAPPED AT THE EXACT AMOUNT PAID BY YOU TO US IN THE NINETY (90) DAYS IMMEDIATELY PRECEDING THE INCIDENT GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL WE BE LIABLE FOR ANY LOST PROFITS, LOSS OF DATA, DEGRADATION OF BUSINESS REPUTATION, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

15. Indemnification

You agree to defend, indemnify, and hold harmless Vontae Mack LLC, its officers, directors, employees, and agents from and against any third-party claims, liabilities, losses, damages, or costs (including reasonable legal fees) arising directly or indirectly from your submitted listing content, the operation or contents of your linked website, or your misuse of the public board.

16. Amendments and Modifications

We reserve the right to update or modify these Terms, the site Rules, pricing models, or the overall gamification mechanics of the Site at any time. Continued use of the Site or submission of listings following the posting of modifications constitutes your acceptance of the revised version. For orders already processed and paid, the specific site Rules in effect at the exact timestamp of payment will govern that order’s immediate noon placement.

17. Termination of Services

We reserve the right to remove any active listing, restrict access, or permanently block any buyer who violates these Terms, our site Rules, or engages in behavior deemed detrimental to the Site community.

18. Governing Law and Jurisdiction

These Terms shall be governed by, construed, and enforced in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law principles. Any legal action, suit, or proceeding arising out of or relating to these Terms must be brought exclusively in the state or federal courts located in Collier County, Florida, and you hereby consent to the personal jurisdiction of such courts.
